  • If You Have a Blood Concentration of .1 milligrams per liter or more of methamphetamine
  • If You have a Blood Concentration of .02 milligrams per liter or more of cocaine or PCP

Even if your car is not in motion, police can still file DWI charges. That’s because the law just needs you to be operating the vehicle. The Virginia State Supreme Court established that you only need to be in control of the car. Even having your keys in the ignition is enough for the charge.
