How Are Demerit Points Established Under Virginia Law?
Anyone who commits a traffic violation could have demerit points assessed on their record. These are active for two years from the date of the offense. Each additional offense will add more points to your record. That could mean suspension and possibly revocation of your license. You could also have to complete a driver improvement clinic, too.
The Number of Points Assessed Vary Depending on the Offense
Virginia assesses between three and six points on your record based on what traffic violation the court finds you guilty of. While many offenses come off your record, there are some that will stay on forever. If you commit a driving offense out of the commonwealth, those offenses will count towards your Virginia record. You Can Also Be Awarded Points for Safe Driving
When you go one year without a violation or suspension in Virginia, you can receive a safe driving point. These are assessed in April based on the previous calendar year. You can receive a maximum of five safe driving points.
If you must attend a driver improvement clinic, the court will determine your eligibility for safe points. You must show proof from the court to the clinic that you attended before the DMV can give points.
