Juvenile Misdemeanor and Felony Differences

Trust Melvin L. Hill Attorney at Law for a Superior Juvenile Court Lawyer

Do you know what the juvenile misdemeanor and felony differences are? Melvin L. Hill Attorney at Law can handle those questions and more. Society believes that kids and adults have different levels of responsibility and potential for rehabilitation. That’s why the two systems exist. There are differences between misdemeanors and felonies at the juvenile level. We’re blogging about some of the ways those crimes are different.

Felonies After a Certain Age Could Be Moved to Adult Court

Under Virginia law, the court can try any minor who is 14-years old or older facing felony charges as an adult. This is generally for crimes such as murder and malicious wounding. The accused has the right to a hearing to decide whether those charges should be in the adult justice system. A judge will need to review the circumstances of the case, and decide if the alleged crime is serious enough. Accused individuals have the right to a hearing on this matter. If it does go to adult court, a juvenile could incur jail time instead of juvenile detention facility.

Misdemeanors May Come Off of Your Record Depending on the Offense

If a Virginia resident committed an offense as a minor, and is now 19 years old, the court orders expungement. The offense drops off his or her record. The important factor is that five years have passed since their last hearing. If both have occurred, the court provides expungement. But if the crime they committed is ancillary to the large event, that could stay on their record. For more information on these matters, check out the Virginia Court System.
