What is Malicious Wounding Under Virginia State Law?

Malicious wounding is a class three felony. Its definition is maliciously shooting, stabbing, cutting, or wounding another person. It must come with the intent to maim, disfigure, disable or kill. If the harm is unlawful, but with no malice, the charge is a class six felony.

The charge elevates to class two if permanent and significant physical impairment occurs. The penalty is one to five years in prison for a class six charge with a $2,500 fine. If the court finds you guilty of a class three charge, it’s five to 20 years with a $100,000 fine. Class two carries a 20-year to life sentence, and the same fine as a class three violation. What Are Acceptable Defenses for a Malicious Wounding Charge?
