When you need a strong criminal defense for malicious wounding, count on Melvin L. Hill Attorney at Law. The Commonwealth of Virginia takes every act of violent crime very seriously, and malicious wounding is no different. These charges can carry heavy consequences if the court finds you guilty. Do you know what malicious wounding is or what is a defense for it? We are taking a closer look in this month’s blog.

What is Malicious Wounding Under Virginia State Law?

Malicious wounding is a class three felony. Its definition is maliciously shooting, stabbing, cutting, or wounding another person. It must come with the intent to maim, disfigure, disable or kill. If the harm is unlawful, but with no malice, the charge is a class six felony.

The charge elevates to class two if permanent and significant physical impairment occurs. The penalty is one to five years in prison for a class six charge with a $2,500 fine. If the court finds you guilty of a class three charge, it’s five to 20 years with a $100,000 fine. Class two carries a 20-year to life sentence, and the same fine as a class three violation. Visit the Virginia State Law Portal for more on this law.

What Are Acceptable Defenses for a Malicious Wounding Charge?

If you were acting in self-defense, the police can’t charge you with the crime. You must prove you were in imminent danger of another person harming you. You must make sure you keep the amount of force you use comparable to the amount you get. Remember, any time someone attacks you, you have the right to defend yourself.

You can also be acting in defense of other people. That includes when you are at work or if you’re out spending time with family and friends. Make sure you have our quality criminal defense attorney to stand up for your rights.
